Justice Oluwatoyin Taiwo of a Lagos State Special Offences Court, Ikeja sentenced a 39-year-old graduate, Babatunde Oladejo to six months imprisonment for being in possession of false documents.
The judge sentenced Oladejo to six months imprisonment after he pleaded guilty to one count charge of amended information brought against him by the Economic and Financial Crimes Commission (EFCC).
EFCC counsel, Mr Samuel Daji told the court that Oladejo falsely represented himself as Lone Wolf to the victim, and defrauded him of over N10 million. He was also alleged of being in possession of fraudulent documents in his HP Elitebook laptop which he used to defraud the victim.
His offence was said to be contrary to Section 318 of the Criminal Law of Lagos State.
Oladejo, who pleaded guilty to the one count of amended information, was asked by the court to confirm the voluntariness of his plea.
The court thereafter asked him to go through the plea bargain protocol wherein he affirmed the voluntariness of the agreement with the anti-graft agency.
Defendant counsel, Mr Adegboyega Adetunji, in his allocutus, pleaded with the court to take cognisance of the fact the convict was a first-time offender and has promised not to be involved in any criminal activities in his life.
Adetunji said, ” he has already purged himself of the illicit fruit, including the balance of the N10 million manager cheque he signed to return the money.
“The convict has sworn to be of good behaviour in the society. He was not the one they were looking for upon his arrest before he was caught and he did not waste the time of the prosecution before owning up to the crime.”
He prayed the court to exercise discretion under Section 313 of the Administration of Criminal Justice Law (ACJL) of Lagos State to give the convict a fine.
Justice Taiwo however sentenced him to six months imprisonment or pay a fine of Two Hundred Thousand Naira (#200,000.00) only. The court ordered items recovered from him to be forfeited to the government.
