A Lagos High Court sitting in Ikeja on Tuesday struck out a case of robbery against Eniola Oyedele due to the failure of the prosecution to produce witnesses since trial commenced.
Justice Hakeem Oshodi dismissed the case while applying Section 232 (1) (b) of the Criminal Justice Laws.
“In view of the absence of witnesses, being police officers, since the inception of trial shows that they are not serious with the matter.
“The court hereby applies Section 232 (1)(b) of the Criminal Justice Laws and hereby dismissed his suit. The defendant is hereby discharged and he shall be released from custody immediately,” he ruled.
The Lagos State prosecutor, Mr Micheal Adeoye, had earlier informed the court that efforts to get the witnesses had not been successful.
The defence counsel, Mrs Eve Obobo, urged the court to strike out the matter.
Oyedele, who was arrested in 2018, was charged with robbery which is against relevant sections of the criminal laws of Lagos State.
