A Lagos State Sexual Offences and Domestic Violence Court sitting in Ikeja has fixed 24th October 2023 for the delivery of judgment in the case of alleged child defilement, sexual abuse and rape levelled against a Lagos-based medical doctor, Femi Olaleye.
Dr. Olaleye was alleged to have in February 2020 and November 2021 raped his wife’s 15-year-old niece.
He allegedly committed the offences at Layi Ogunbambi Close, Maryland, Lagos residence of the couple.
Olaleye was also accused of sexually assaulting the survivor by penetrating her mouth with his penis.
The Lagos State government further alleged that he perpetrated the crime for about 19 months until the wife discovered it and reported to the Lagos State Police Command for investigation.
However, following the adoption of the final written addresses by counsel on both sides on Friday, the presiding judge, Justice Rahmon A . Oshodi announced that he has reserved judgment till Thursday 24th of October 2023.
In his submission and prayer, the defence team, led by Mr Segun Fabunmi (SAN) urged the court to discharge and acquit the defendant, while the Lagos State’s Director of Public Prosecution, Dr Babajide Martins, citing different authorities to buttress his position, urged the court to convict and sentence the defendant as charged.
Dr. Martins pointed out that the prosecution has established prima facie evidence against the defendant and should be convicted accordingly.
It will be recalled that the Office of the Director of Public Prosecution (DPP) late last year charged Dr Femi Olaleye to court for allegedly having carnal knowledge of his 15-year-old niece. Mrs Aderemi Olaleye had accused her husband of defiling her niece and having sexual intercourse with the minor on a number of occasions.
