A Sexual Offences and Domestic Violence Court, Ikeja earlier today asked parties in an ongoing trial of the Medical Director of Cancer Care Foundation, Dr. Olufemi Olaleye to file their written addresses in the no-case submission application.
The trial judge, Justice Rahmon Oshodi directed parties to file their written addresses on the application brought by the defence before 16th March fixed for the adoption of written addresses.
The judge’s directives was sequel to the prosecution submission that is closing its case against the defendant after calling six witnesses.
The Lagos State government had arraigned Dr. Olaleye before Justice Rahmon Oshodi for allegedly defiling his wife’s 16-year-old niece.
At the resumed proceeding, the state Director of Public Prosecutions (DPP), Dr. Babajide Martins, told the court that the prosecution was ready to close its case after calling six witnesses
Defence counsel, Mr. Babatunde Ogala (SAN), however, informed the court that the defence had made a no-case submission.
Justice Oshodi consequently closed the prosecution’s case and adjourned until 16th March for the adoption of written addresses on the no-case submission.
Dr. Olaleye is standing trial on a two-count charge of defilement and sexual assault by penetration.
He, however, pleaded not guilty.
An Investigative Police Officer (IPO), Insp. Abe Leonard had on 26th January gave evidence against the defendant while a forensic expert at the Mirabel Centre, Lagos, Mrs. Oyebimpe Akinbunmi, and Insp. Esther Igbineweka testified against the medical director on 4th January.
Mrs. Olabisi Ajayi-Kayode, a Child Forensic Specialist with the Cece Yara Foundation, on 3rd January also gave evidence against the defendant.
The alleged victim, on 21st December 2022, testified against the defendant in a closed hearing in line with the 1999 Constitution and the Administration of Criminal Justice Act.
The wife of the defendant, Mrs. Aderemi Fagbemi-Olaleye, on 19th December 2022, told the court that her husband was diagnosed with sex addiction.
The alleged offences violate sections 137 and 261 of the Criminal Law of Lagos State, 2015.
