THE Abuja division of the Court of Appeal has upheld the reinstatement of Mr Philip Shaibu as the deputy governor of Edo State, dismissing the state House of Assembly’s appeal.
It will be recalled that a Federal High Court sitting in Abuja presided over by Justice James Omotosho had earlier declared Shaibu’s impeachment invalid and mandated his immediate reinstatement. The trial judge had warned that any other individual who attempts to assume the title of ‘deputy governor’ of the state will face legal consequences.
This judgment comes in the wake of Shaibu’s controversial impeachment on 8 April, where the Assembly levelled varying allegations against him, including perjury and leaking government secrets. However, Justice Omotosho had ruled that the impeachment process violated due process, leading to the restoration of Shaibu into office.
Justice Omotosho also nullified the appointment of Omobayo Godwins as the new deputy governor and directed the Inspector-General of Police to ensure Shaibu’s security as he resumed his duties until the completion of his term.
The political landscape of Edo State hangs in the balance, as this ruling not only reinforces Shaibu’s position but also casts a shadow over the actions of the Assembly.
