Governor Babajide Sanwo-Olu of Lagos State has filed a counter affidavit to the statement of claim of Emmanuel Moses stating that he will not waive his immunity to undergo a DNA test as requested by his acclaimed love child.
Emmanuel had early in the year approached a Delta State High Court sitting in Effurun, claiming that Governor Babajide Sanwo-Olu of Lagos State was his biological father based on revelation by his mother. He said his mother told him that Mr Sanwo-Olu was the same man who impregnated her when he was observing the mandatory one-year youth service corps in Warri some 27 years ago.
Emmanuel had therefore approached the court asking it to compel Mr Sanwo-Olu to waive his immunity for a DNA test to determine if he is his father or not.
Emmanuel’s lawyer John Aikpokpo- Martins wrote on his Facebook page after the court proceeding yesterday:
“With Emmanuel Sanwo-Olu at the Effurun High Court today. Emmanuel the acclaimed son of Babajide Sanwo-Olu, the Executive Governor of Lagos State had approached the Delta State High Court claiming that the Governor is his biological father and requested the governor to waive his constitutional immunity and undergo a DNA test to confirm his (Emmanuel) paternity. Surprisingly and shockingly, Mr Babajide Sanwo-Olu in a response filed processes refusing to waive his immunity and undergo a DNA test.
“The case was adjourned to 17th January 2023 to hear the objection of the governor.”
Emmanuel, in a suit, claimed that Sanwo-Olu had a relationship with his mother in 1994/95, of which he is the product.
In his 19-paragraph statement of claim attached to the Writ of Summons written by his counsel, Emmanuel recalled that Sanwo-Olu, who at the time served with a private company operating in Warri, Delta State from 1994 to 1995, dated one Grace Moses (his mother) from Oleri Village near the Warri metropolis, during the period.
He further alleged that the romantic relationship resulted in the said Grace Moses getting pregnant for the governor. Sanwo-Olu allegedly absconded after he was informed of the pregnancy, and never reached out ever since.
He disclosed that he knew his real father after pressuring his mother who raised him alone, adding that he would later recognise Sanwo-Olu on television sometime in 2022.
“The recorded video of the television broadcast of the defendant was also played for the claimant’s mother and she instantaneously and positively identified the defendant as the Jide Sanwo-Olu who was in Delta State from 1994-95, and whom she had a scintillating affair with; got her pregnant and the father of the claimant,” the document said.
Emmanuel said all attempts to reach the defendant proved abortive, hence the reason why he instigated the legal action.
The claimant prayed the court to declare that Sanwo-Olu is his biological father as well as an order to compel the governor to accord him all the rights of a son.
