A Lagos High Court sitting in Ikeja has fixed 28th November 2022 for the adoption of written addresses in the suit against the Onitire of Itire and the Chairman of Mushin Local Government Area and others.
Justice Yetunde Pinheiro fixed the date in the suit marked ID/3669GCNW/2017 wherein the plaintiff claimed that being a descendant of Odunburu Ruling House is entitled to be considered eligible to contest for the said stool of Onitire of Itire.
The claimants; Alhaji Walim Abolaji Irawo, Alhaji Chief Teslim Alani Apena, Chief Rasheed Yekinni Apena, Taiwo Ogundipe, Chief (Mrs) Afusat Williams, and Alhaji Chief Jimoh Amusa Irawob sued for themselves and on behalf of Omobo branch of Odunburu Ruling House of Itire.
Aside from the Chairman of Mushin Local Government Area and Onitire of Itire, other defendants in the suit are; Chief Adisa Olatunji, the Commissioner for Local Government and Community Affairs, The Governor of Lagos State, and the Attorney-General of Lagos State.
The claimant had prayed the court for a declaration that Odunburu Ruling House is made up of seven branches; Lesho, Owunro, Aina, Abija Eru, Ejolabi, Omobo, Oluwole, and Orebiyi are descendants of Omobo branch.
“A declaration that the first claimant, being a descendant of Odunburu Ruling House, is entitled to be considered eligible to contest for the said stool of Onitire of Itire.
They, therefore, prayed the court for an order restraining the 1st, 2nd, 3rd, 4th and 5th defendants from acting on public notice published on the 16th January 2017, or carrying out any exercise to fill the vacant stool of Onitire, pending the determination of the suit.
The court had ordered the parties to maintain the status quo pending the final determination of the suit.
Despite the pendency of the suit coupled with an order to maintain the status quo, Oba Tajudeen Ishola Odubiyi was installed as Onitire of Itire. The claimant, therefore, threatens to file contempt proceedings against the defendants.
The case has been adjourned till 28 November 2022.
